CSV.2.9.160 Incidental Take by Gillnet

(a) No member shall retain possession of any species of fish taken in excess of the daily bag limit by the use of a gillnet authorized by Section CSV.2.9.080 and no member shall fail to either:

(1) Return to the water any such fish which appears capable of surviving; or

(2) Transfer possession of such fish as soon as practicable to the tribal conservation department or to a person authorized to enforce this ordinance.

(b) Any such fish transferred pursuant to Section CSV.2.9.160(a)(2) shall be disposed of by the tribe for charitable purposes but shall not be returned to the member or his or her immediate family.
