CSV.1.9.050 Seasons, Methods, Bag Limits, and Size Limits; Specific Regulations

Upon the determination of the tribal conservation department and the corresponding approval of the Tribal Governing Board, the fishing season may be changed if it is in the best interest of the Tribe to do so. All dates given in this section are inclusive:

(a) Annual fishing seasons for the time period provided in Section CSV.1.9.050(b), are hereby established.

(b) For the purposes of fishing, the season for all species shall be year around.

(1) Notwithstanding, the tribal conservation department may restrict the fishing of any species in any way it deems necessary at any time. Restrictions may include but are not limited to specifying the open season in which fishing is permitted, specifying the permissible methods by which fishing is permitted, specifying the size limit of a fish that may be harvested, specifying the daily bag limit of fish that may be harvested, or specifying the location where fish harvest may be permitted.

(c) Notwithstanding any other provision of this section, nothing in this section shall be construed to infringe upon the issuance of a permit according to the traditions and custom of the Tribe pursuant to Section CSV.1.1.090 of this ordinance.

(d) Notwithstanding any other provision of this section, nothing in this section shall be construed to authorize small game harvest or the opening of a small game harvest season contrary to an Emergency Closure Order issued pursuant to Section CSV.1.3.300 of this ordinance.
