Resolution No. 2025-169 — Amending LCO TCL PHS, Tattoo and Body Piercing Ordinance

WHEREAS, the Lac Courte Oreilles Band of Lake Superior Chippewa Indians is a federally recognized Indian tribe ("Tribe") organized pursuant to the provisions of the Indian Reorganization Act of 1934, 25 U.S.C. §5101, et seq.; and,

WHEREAS, the Tribal Governing Board serves as the governing body of Lac Courte Oreilles Band of Lake Superior Chippewa Indians pursuant to Article III, § 1 of the Amended Constitution and Bylaws of the Lac Courte Oreilles Band of Lake Superior Chippewa Indians; and

WHEREAS, pursuant to Article V, § 1(n) of the Amended Constitution and By-laws of the Lac Courte Oreilles Band of Lake Superior Chippewa Indians, the Tribal Governing Board is empowered to "regulate, by enactment of ordinances, the conduct of business within the territory of the band"; and

WHEREAS, pursuant to Article V, Section 1 (s) of the Amended Constitution and Bylaws of the Lac Courte Oreilles Band of Lake Superior Chippewa Indians, the Tribal Governing Board possesses certain powers, including: "To promulgate and enforce ordinances governing the conduct of members of the Lac Courte Oreilles Band of Lake Superior Chippewa Indians of Wisconsin and providing for the maintenance of law and order and the administration of justice by establishing a tribal court and defining its duties and powers."; and

WHEREAS, the Tribal Governing Board duly enacted the Lac Courte Oreilles Tattoo and Body Piercing Ordinance to regulate any related activities on reservation.

NOW THEREFORE BE IT RESOLVED, that the Tribal Governing Board hereby determines that it is in the best interest of the Tribe to amend the Tattoo and Body Piercing Ordinance.

NOW THEREFORE BE IT FINALLY RESOLVED, that the attached amendment Title PHS.7 Tattoo and Body Piercing Ordinance of the Lac Courte Oreilles Band of Lake Superior Chippewa Indians of the Lac Courte Oreilles Tribal Code of Law, including all Attachments, shall be, and hereby is, amended and enacted as an ordinance of the Tribe, pursuant to Article IV, § 3 of the Amended Constitution and Bylaws of the Lac Courte Oreilles Band of Lake Superior Chippewa Indians as follows:

1. PHS.7.1.080 General Definitions is amended as follows: "(g)" "Tattoo and Body Piercing Regulator or Division" can be used interchangeably and means any agencies or individual(s) designated by the Tribal Governing Board, who shall be authorized to make investigations or inspections of tattooists, body piercers, tattoo establishments and body piercing establishments, including vendors at any venue, and recommend to the Tribe whether an establishment or practitioner be licensed or is in compliance with the requirements of this law;

2. PHS.7.1.080 General Definitions is amended as follows: "(i)" "Establishment" means a building, structure, venue, area or location where tattooing and/or body piercing is performed;

3. PHS.7.1.080 General Definitions is amended as follows: "(k)" "Department" means the Tribal Governing Board, or any licensing authority, or any individual(s) appointed by the Tribal Governing Board with the authority to implement, administer, and enforce this ordinance;

4. PHS.7.1.080 General Definitions is amended as follows: "(o)" "Reservation" means all lands and waters within the exterior boundaries of the LCO reservation in Wisconsin, as established by Secretarial Order March 1, 1873, and any lands or waters or interests therein which may be acquired outside of the reservation by or on behalf of LCO, including, but not limited to the 1200 acres of Farm Services Administration land outside the 1873 reservation boundary held by the United States, and the Reservation Proclamation of 2017, adding 2012.77 acres, except as may otherwise be provided by federal law;

5. PHS.7.1.120 Establishment License is amended as follows: "(c)" "Temporary Establishments" For a temporary tattoo or body piercing establishment or a temporary combined tattoo and body piercing establishment, the operator of the establishment shall pay a fee of $100 per application. The fee shall not be returned if the establishment fails the inspection. For any temporary establishment(s) operating at a venue held by or at the Sevenwinds Casino, Lodge & Conference Center, the Department/Regulators may waive the fee.

6. PHS.7.1.130 Practitioner License is amended as follows: "(a)" "Requirement" No person may tattoo or body pierce another person, use or assume the title of tattooist or body piercer or designate or represent himself or herself as a tattooist or body piercer unless the person has obtained a practitioner license from the Department by application made upon a form furnished by the Department. An application submitted to the Department shall be accompanied by the fee required under Section PHS.7.1.130(d), unless waived under Section PHS.7.1.130(d)(3). The fee shall be returned in full if the application is denied.

7. PHS.7.2.130 Practitioner License is amended as follows: "(d)(3)" For events venues held at the Sevenwinds Casino, Lodge & Conference Center, the Department/Regulators may waive the fee as necessary.

8. PHS.7.1.140 Approval of Licenses is amended as follows: "(b)" The Division shall not recommend the Department issue a license to a new tattoo or body-piercing establishment or a new operator at an existing establishment without completing a prior inspection of the establishment to ensure that the establishment complies with the requirements of this law. In the instance that the temporary establishment is operating at an event or venue held by or at the Sevenwinds Casino, Lodge & Conference Center, the Division shall be allowed to recommend a license to any vendor, however, the Division must inspect the vendors booth/area and ensure it complies with this ordinance prior to the vendor offering any services.

9. PHS.7.1.200 Physical Facilities and Environment is amended as follows: "(l)" In instances where the Temporary Establishment is located at a venue or event being held by or at the Sevenwinds Casino, Lodge & Conference Center, any specific requirements of Section PHS.7.1.200 may be waived by the Division, so long as reasonable measures are in place to ensure the safety, cleanliness, and sanitary conditions necessary for the health and well being of any patrons.

10. PHS.7.1.330 Temporary Establishments is amended as follows: "(c)" No temporary establishment may be operated without a temporary establishment license, unless the temporary establishment is operating at an event or venue held by or at the Sevenwinds Casino, Lodge & Conference Center. An application for a temporary establishment license shall be made under Section PHS.7.1.120 and shall be accompanied by the fee required under Section PHS.7.1.120(c), unless the temporary establishment is operating at an event or venue held by or at the Sevenwinds Casino, Lodge & Conference Center.

11. PHS.7.1.330 Temporary Establishments is amended as follows: "(d)" No temporary establishment license shall be issued without a prior inspection, unless the temporary establishment is operating at an event or venue held by or at the Sevenwinds Casino, Lodge & Conference Center, in which case the license may be issued but the vendor may not engage in services until inspected and approved to do so by the Division. In either instance, a pre-inspection fee as required under Section PHS.7.1.100(b) shall not be charged.
