Resolution No. 2024-94 — Repeal of the Recategorized "General Welfare Services Immediate Assistance Funds Ordinance GWE.2" from the Lac Courte Oreilles Tribal Code of Law

WHEREAS, the Lac Courte Oreilles Band of Lake Superior Chippewa Indians is a federally recognized Indian tribe ("Tribe") organized pursuant to the provisions of the Indian Reorganization Act of 1934, 25 U.S.C. §5101, et seq.; and,

WHEREAS, the Tribal Governing Board serves as the governing body of Lac Courte Oreilles Band of Lake Superior Chippewa Indians pursuant to Article III, § 1 of the Amended Constitution and Bylaws of the Lac Courte Oreilles Band of Lake Superior Chippewa Indians; and

WHEREAS, the Tribal Governing Board is empowered to "administer any funds within the control of the Band" pursuant to Article V, §1(j); and

WHEREAS, the Tribal Governing Board is further empowered to "regulate, by enactment of ordinances, the conduct of business within the territory of the band" pursuant to Article V § 1(n); and

WHEREAS, the Tribal Governing Board recognizes that there are emergencies and situations where Tribal Members may need immediate financial assistance; and

WHEREAS, the Tribal Governing Board, in accordance with the Tribal General Welfare Exclusion Act of 2014 Section 139E, established the LCOTCL GWE.1; and

WHEREAS, the GWE.1 allows for tribal funds be made available to Tribal Members through various safe harbor benefits programs in accordance with Department of Treasury and Internal Revenue Service Published Revenue Procedure 2014-35; and

WHEREAS, the Tribal Governing Board enacted the General Welfare Services Immediate Assistance Funds Ordinance Resolution No. 2023-19, also known as the GWE.2; and

WHEREAS, the Tribal Governing Board on April 15, 2024, approved to remove Section 2 of the GWE Subchapter and recategorize; and

WHEREAS, the enactment of GWE.2 as drafted and adopted is contrary to the General Exclusion Act of 2014 Section 139E, GWE.1 and Louis D. Taylor v. James Schlender Jr. 23-CV-287; and

WHEREAS, the Tribal Governing Board does not support the continuance of Tribal Governing Board Members having a quarterly allowance to distribute at that Members discretion as such distributions are not considered safe harbor benefits under the General Welfare Act; and

WHEREAS, the Tribal Governing Board does not want tribal members to be financially liable for funds received through Tribal Governing Board members that is not eligible for income tax exclusion; and

WHEREAS, the Tribal Governing Board will establish an approved emergency funds and other immediate assistance for tribal members via an articulated program that is available for all eligible tribal members; and

WHEREAS, the Tribal Governing Board will further establish a Committee that will oversee the emergency assistance program to ensure that funds are properly distributed to tribal members and such distributions are not overseen by Tribal Governing Board members; and

WHEREAS, the Tribal Governing Board shall require a majority consensus of four for any expenditures from the Donations Account and any other Tribal Fund pursuant to the Amended Constitution and Bylaws of the Lac Courte Oreilles Band of Lake Superior Chippewa Indians Article V,§1(j) which mandates that "[n]o payment of expenditures shall be made unless such payment conforms with a duly approved Tribal budget."

NOW THEREFORE BE IT RESOLVED, the Tribal Governing Board hereby repeals the recently recategorized GWE.2 to allow for Tribal Governing Board compliance with the applicable governing laws. Any and all expenditures shall require a majority consensus of four from the Tribal Governing Board.

I, the undersigned, as Secretary/Treasurer of the Lac Courte Oreilles Tribal Governing Board, hereby certify that the Tribal Governing Board is composed of seven (7) members, of whom 7 being present, constituted a quorum at a meeting thereof, duly called, convened, and held on this 9th day of September, 20249th day of September, 2024, that the foregoing Resolution was duly adopted at said meeting by an affirmative vote of 4 members, 3 against, 0 abstaining, and that said Resolution is a lawful act of the Tribe.
