Resolution No. 2023-43 — Adopting GNC.4.4.015 Banning Electric Smoking Devices into the Lac Courte Oreilles Tribal Code of Law
WHEREAS, the Lac Courte Oreilles Band of Lake Superior Chippewa Indians is a federally recognized Indian tribe ("Tribe") organized pursuant to the provisions of the Indian Reorganization Act of 1934, 25 U.S.C. §5101, et seq.; and,
WHEREAS, the Tribal Governing Board serves as the governing body of Lac Courte Oreilles Band of Lake Superior Chippewa Indians pursuant to Article III, § 1 of the Amended Constitution and Bylaws of the Lac Courte Oreilles Band of Lake Superior Chippewa Indians; and
WHEREAS, pursuant to Article V, §1(s) of the Amended Constitution and Bylaws of the Lac Courte Oreilles Band of Lake Superior Chippewa Indians, the Tribal Governing Board is empowered to "to promulgate and enforce ordinances governing the conduct of members of the Lac Courte Oreilles Band of Lake Superior Chippewa Indians and providing for the maintenance of law and order and the administration of justice…" and
WHEREAS, the Tribal Governing Board has the authority and the responsibility to provide for the safety, health, and welfare of its members and over its territory within the exterior boundaries of the Lac Courte Oreilles Reservation; and
WHEREAS, the Tribal Governing Board passed Resolution 71-2021 Banning Electronic Smoking Devices at all tribal buildings and businesses located within the Reservation; and
WHEREAS, the Tribal Governing Board now adopts GNC.4.4.015 which codifies the Banning of Electronic Devices into the Lac Courte Oreilles Code of Law; and
WHEREAS, the codified Banning of Electronic Devices allows all Tribal law enforcement to issue citations for individuals who violate GNC.4.4.015.
NOW THEREFORE BE IT RESOLVED, that the Tribal Governing Board hereby codifies the Banning of Electronic Devices on all tribal buildings and businesses located within in the Reservation into GNC.4.4.015 as follows:
Banning of Electric Devices
Whoever uses, sells, or possesses electronic smoking devices at any tribal building, or any business located within the Reservation, shall receive a citation in the amount of one hundred dollars ($100).
CERTIFICATION
I, the undersigned, as Secretary/Treasurer of the Lac Courte Oreilles Tribal Governing Board, hereby certify that the Tribal Governing Board is composed of seven (7) members, of whom 6 being present, constituted a quorum at a meeting thereof, duly called, convened, and held on this 10th day of May 2023, that the foregoing Resolution was duly adopted at said meeting by an affirmative vote of 5 members, 0 against, 0 abstaining, and that said Resolution is a lawful act of the Tribe.
