Resolution No. 2023-102 — Adoption of the Lac Courte Oreilles Band of Lake Superior Chippewa Indians Code of Law: Subchapter DMR.1.11 Guardian Ad Litem Code

WHEREAS, the Lac Courte Oreilles Band of Lake Superior Chippewa Indians is a federally recognized Indian tribe ("Tribe") organized pursuant to the provisions of the Indian Reorganization Act of 1934, 25 U.S.C. §5101, et seq.; and,

WHEREAS, the Tribal Governing Board serves as the governing body of Lac Courte Oreilles Band of Lake Superior Chippewa Indians pursuant to Article III, § 1 of the Amended Constitution and Bylaws of the Lac Courte Oreilles Band of Lake Superior Chippewa Indians; and

WHEREAS, pursuant to Article V, including but not limited to, §1(q) and (s) of the Amended Constitution and Bylaws of the Lac Courte Oreilles Band of Lake Superior Chippewa Indians, empowers the Tribal Governing Board to "establish a tribal court for the purpose of enforcing tribal ordinance" Article V, §1(q) and "to promulgate and enforce ordinances governing the conduct of members of the Lac Court Oreilles Band of Lake Superior Chippewa Indians of Wisconsin and providing for the maintenance of law and order and the administration of justice by establishing a tribal court and defining its duties and powers" Article V, §1(s); and

WHEREAS, the Tribal Governing Board is empowered to "provide for the regulation of child custody and domestic relations matters by ordinances or resolution," Article V, §1(t); and

WHEREAS, it is the primary objective of this ordinance to protect the health, safety, and welfare of all children within the jurisdiction of the Lac Courte Tribe as the children are the Tribe's future; and

WHEREAS, the purpose of the appointment of a guardian ad litem to a court proceeding is to represent and advocate for the best interests of the child; and

WHEREAS, the duties and responsibilities of a guardian ad litem are vital to the court and such duties and responsibilities need to be outlined to further protect the best interests of children in all proceedings.

NOW THEREFORE BE IT RESOLVED, that the Tribal Governing Board hereby adopts the attached Subchapter DMR.1.11 Guardian Ad Litem code to regulate the duties and responsibilities of guardian ad litems in our Tribal Court.

I, the undersigned, as Secretary/Treasurer of the Lac Courte Oreilles Tribal Governing Board, hereby certify that the Tribal Governing Board is composed of seven (7) members, of whom 7 being present, constituted a quorum at a meeting thereof, duly called, convened, and held on this 7th day of August 2023, that the foregoing Resolution was duly adopted at said meeting by an affirmative vote of 6 members, 0 against, 0 abstaining, and that said Resolution is a lawful act of the Tribe.
