MCC.7.3.020 Donation Application, Donation Program is program of last resort.
(a) Eligibility. Any applicant and recipient of a donation may be required to demonstrate individual or family need. All applicants and recipients of a donation must comply with the following sections.
(b) Must request other tribal assistance first. Individual Assistance Donations Program is a program of last resort. The Individual Assistance Donations Program is a program of last resort, meaning that all applicants must apply for, and be rejected from, another tribal program that handles assistance for the same matter or type of benefit requested. No assistance will be granted by the Individual Assistance Donations Committee unless the applicant has provided proof of rejection from another program. Proof of rejection means a physical document describing the assistance requested and shall contain the other tribal program's written denial for ineligibility or other reasons.
(1) Prior to receiving a donation, all applicants shall first seek for, and be rejected from, a donation the following programs.
(A) Energy Assistance Program for assistance with utilities payments.
(B) General Assistance Program for assistance with cash benefits.
(C) Income Maintenance/Child Care for childcare assistance.
(D) Consolidated Tribal Government Program for assistance with work/job skills, utilities, rent, childcare assistance, shuttle tokens, food, clothing, and tools.
(E) Native Employment Works (NEW) Program for assistance with work/job skills, cash benefits, shuttle tokens, and vehicle repairs/fees.
(F) Temporary Assistance for Needy Families (TANF) for assistance with work/job skills and cash benefits.
(G) LCO Elder Services Program for assistance with vehicle repairs and minor home repairs.
(H) Vocational Rehabilitation Program for assistance with work/job skills, shuttle tokens, vehicle repairs fees, clothing, and tools.
(I) Workforce Investment Act (WIOA) for assistance with work/job skills.
(J) Food Distribution for assistance with food.
(K) LCO Indian Child Welfare & Family Services for assistance with utilities, transportation, and clothing.
(L) LCO Independent Living for work/job skills, utilities, rent, transportation, vehicle repairs/fees, clothing, and tools and teaching in independent living skills.
(M) Kinship Program for assistance with work/job skills and cash benefits, and clothing (when funding allows).
(N) LCO Health Center Medical Transportation for assistance with transportation, delivery of medications, and medical supplies.
(O) PRC2, Payor of Last Resort Program for reimbursement and or payment for eligible medical expenses.
(P) Or any other assistance program that the Tribe may develop in the future, from time to time.
(2) Upon the required showing of proof of rejection or ineligibility from one of the above programs, the requested assistance must be the same type of assistance that was requested from the rejecting program.
(c) Ineligibility. An individual is ineligible for Individual Assistance Donation if they have already received a Donation in the proceeding 12-month period and/or have reached the yearly donation limit of $1,000. Applicants are ineligible for a donation if they have not provided written proof of the denial of assistance from another tribal program.
(d) Initiating an Application. Applications for assistance must be written and clearly stated on a form developed by the Tribal Governing Board.
(e) Required Application Information. Each applicant is responsible for submitting all required materials and authorizations.
(1) A completed Donation application shall include, at a minimum, the following:
(A) Full legal name;
(B) Date of Birth;
(C) Street address, city, state, and zip code;
(D) Phone number;
(E) E-mail address;
(F) Enrollment number and a copy of the applicant's Lac Courte Oreille enrollment card;
(G) Employment status and wage information;
(H) the applicant's records of prior donation requests, including denials;
(I) the total amount requested;
(J) a personal written statement or declaration from the applicant that a hardship exists, including the reason(s) for requesting a Donation, and that all information provided is accurate and in accordance with Tribal and federal law. The signature of the applicant, electronic or handwritten, is required to affirm the declaration; and
(K) A written denial of assistance from another tribal program.
(f) Incomplete Application Consequences. Failure of the applicant to provide a complete application, or any of the required information and/or materials may result in:
(1) the application being returned with a request for more information; or
(2) the application being removed from consideration; or
(3) denial of a Donation.
(g) Applicant Misrepresentation: If a Donation is granted and it is later determined that information was misrepresented or false, or pertinent information was purposefully omitted, the Tribal Governing Board shall have the right to rescind the Donation and direct the Office of the Attorney General to recover, through court action or wage garnishment, the amount of the Donation granted and any and all costs incurred by the donation request or the recovery thereof.
(h) Falsifying a Donation Application: The Donations Committee reserves the right to deny any donation application that:
(1) is used in conjunction with criminal conduct,
(2) is fraudulently presented for illegitimate purpose(s), or
(3) the committee has been purposefully misled about the use, or intended use, of a donation.
