CTZ.1.6.060 Burden of Proof and Evidence of Eligibility

(a) The applicant shall have the burden of proof in establishing to the Tribal Governing Board by clear and convincing evidence that the applicant meets all of the requirements for Tribal Citizenship (Membership).

(b) The evidence, which an applicant may submit in support of an application, shall be limited. All documentary evidence shall be certified documentary evidence as defined in Section CTZ.1.2.010(e), and be limited to: birth certificates as defined in Section CTZ.1.2.010(c); genealogical records as defined in Section CTZ.1.2.010(l) and as further explained in Section CTZ.1.2.010(k), Section CTZ.1.2.010(m), Section CTZ.1.2.010(n); sworn affidavits as defined in Section CTZ.1.2.010(v) from persons having personal knowledge of the facts at issue; and the records of the Bureau of Indian Affairs as defined in Section CTZ.1.2.010(d).

(c) The Governing Board shall consider all other relevant evidence except as limited herein regarding the applicant's eligibility for enrollment and shall have the authority to determine the relevance, weight and sufficiency of such evidence.
